Terms and Conditions of Membership and Use

1. Acceptance of Terms

By accessing or using our gym facilities and services, you signify your agreement to be bound by these Terms and Conditions, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our facility. These terms govern your use of our physical gym location and any associated online platforms or services we may offer.

2. Membership

• Eligibility: Membership is open to individuals who are 18 years of age or older. Minors between 14 and 17 years old may be eligible for membership with the express written consent and co-signature of a parent or legal guardian, and must adhere to all gym policies regarding minors.
• Application: All prospective members must complete a membership application form and provide accurate and complete information. We reserve the right to deny membership to any individual.
• Membership Dues: Membership dues are payable in advance according to the chosen membership plan. All payments are non-refundable, except as explicitly stated in these terms or as required by law.
• Renewal: Memberships are subject to renewal based on the terms of the individual plan chosen. It is the member's responsibility to manage their renewal preferences.
• Cancellation: Members may cancel their membership in accordance with the specific terms outlined in their membership agreement. Depending on the plan, cancellation may require advance notice.

3. Use of Facilities

• Safety: Members are expected to use all equipment and facilities safely and responsibly. Proper technique should be observed. If you are unsure how to use any equipment, please ask a staff member for assistance.
• Attire: Appropriate athletic attire, including closed-toe athletic shoes, must be worn at all times in workout areas.
• Hygiene: Members are requested to maintain good personal hygiene. Wiping down equipment after use is mandatory for the health and safety of all members.
• Personal Belongings: We provide lockers for temporary storage of personal belongings. However, we are not responsible for any lost, stolen, or damaged items within our facility or on our premises.
• Code of Conduct: Disruptive, aggressive, or inappropriate behavior towards other members or staff will not be tolerated and may result in immediate termination of membership without refund.
• Photography/Videography: The use of cameras or video recording devices within the gym, particularly in locker rooms or restrooms, is strictly prohibited to protect the privacy of all members. Limited personal photography is permitted in public areas, provided it does not disturb others or infringe on their privacy.

4. Health and Medical Disclaimer

You acknowledge that participation in physical exercise carries inherent risks. You are advised to consult with a medical professional before beginning any exercise program, especially if you have pre-existing health conditions. By using our facilities, you affirm that you are in good physical condition and do not suffer from any disability or medical condition that would prevent or limit your participation in exercise activity. We are not responsible for any injuries that may occur while using our facility, except in cases of gross negligence on our part.

5. Limitation of Liability

To the fullest extent permitted by law, our gym, its owners, employees, and affiliates will not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, or other intangible losses resulting from the use or inability to use our facilities or services.

6. Intellectual Property

All content visible on our online platforms, including text, graphics, logos, images (including the 10 big size pictures of our gym), and software, is the property of our gym or its content suppliers and protected by international copyright laws. Any unauthorized use is strictly prohibited.

7. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on our online platform and will become effective immediately upon posting. Your continued use of our facilities or services after such modifications constitutes your acceptance of the new Terms.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Ontario, Canada.
